The firm represents and counsels landlords, tenants and property management companies in a variety of leasing transactions, including negotiating leases for shopping centers, retail office space, free-standing retail stores, and other build-to-suit leases, ground leases and subleases, as well as negotiating leases on behalf of governmental entities. Our lawyers understand the need to quickly negotiate and document the transaction, as well as the importance of minimizing and advising our clients as to the potential legal and business risks.
Our lawyers handle a broad range of commercial and residential real estate finance transactions and are experienced in representing private companies, developers, commercial and individual borrowers, financial institutions, contractors, hospitals and governmental entities in mortgage financing transactions, including acquisition financing, construction financing, project financing, bridge loans, leasehold financing, subordinated debt and other mezzanine financing, and permanent financing. Our experience with real estate finance transactions covers a broad array of projects, including office buildings, retail centers, hotels, multi-family housing, condominiums and residential tract developments. When necessary, our lawyers are prepared to handle the prosecution or defense of foreclosure, bankruptcy and related litigation on behalf of our clients.
Real Estate Acquisitions and Dispositions
We represent owners, developers and investors in the acquisition and development of land for commercial, retail and residential real estate projects, including condominiums, mixed-use developments and healthcare facilities, and in the selling and disposition of real estate. The firm is experienced with the negotiation and preparation of purchase agreements, due diligence, review of title documents, issuing title insurance and other matters relevant to the acquisition and disposition process. For any transaction requiring financing, our lawyers have extensive experience with lender requirements and take a hands-on approach to negotiating loan documents and satisfying lender’s conditions. We also assist in the formation of holding companies and other entities for the purpose of buying and selling real estate.
Real Estate Development
We have extensive experience representing developers of commercial, residential and mixed-use condominiums, residential subdivisions, hotels and other mixed-use developments. We provide a complete range of services to our clients for the development and construction of real estate projects and represent clients through the development process, from due diligence, acquisition and financing of the property, to the structuring, approvals, development, construction and sale or lease of the property. Our lawyers are well-versed in the development and operation of master-planned and resort communities and preparing the various documents needed to ensure the proper creation of such communities.
Our lawyers represent insureds and lenders in all aspects of title insurance, including title insurance policies, endorsements and opinions. Beggs & Lane acts as an authorized agent for major title insurance companies, including Chicago Title Insurance Company, Fidelity National Title Insurance Company, First American Title Insurance Company, and Old Republic National Title Insurance Company. Our experience extends to representing title insurance companies and insureds in litigation involving title insurance issues and disputes.
