Congratulations to Beggs & Lane attorneys John H. Adams and Cecily Parker for their recent appellate victory in a contested probate matter before the Florida First District Court of Appeal. John and Cecily’s client petitioned the probate court to appoint his mother’s longtime friend and attorney, who was nominated as personal representative in his mother’s will, as the personal representative of his mother’s probate estate. When the trial court refused to appoint the personal representative nominated in the will, John and Cecily appealed. Upon review, the First District Court of Appeal reversed the probate court and explained that Florida Law requires a probate court to appoint a personal representative nominated in a will if that personal representative is otherwise qualified to serve under the provisions of the Florida Probate Code. John and Cecily regularly handle litigation and appeals concerning probate, trusts, and guardianships.
